Description:
Aluminum and copper importers now face closer UFLPA scrutiny. Both metals are designated high-priority enforcement sectors, and the UFLPA Entity List grew to 187 entities in August 2026. When CBP detains a shipment, the importer must prove that no input at any tier traces to Xinjiang or to a listed entity. That means records reaching past the Tier 1 supplier to the smelter, the refiner and the ore source.
This guide explains what UFLPA detention evidence CBP expects. It covers the difference between the out-of-scope path and an exception request, and why affidavits, redacted files and incomplete sub-tier data are unlikely to satisfy the agency. It also shows where sub-tier tracing usually breaks down and how the response timeline works after a detention notice. The final section lays out six practical steps to build a detention-ready evidence file before a shipment is ever held, from mapping metal inputs to the bill of materials to making traceability a contract term.
